Welcome to AutoTalk Solutions Inc. ("AutoTalk," "we," "us," or "our"). By using our services, including our SMS/text messaging programs, you agree to these Terms of Service. Please read them carefully.

1. SMS Text Messaging Program

Program Name: AutoTalk SMS Notifications

AutoTalk Solutions offers SMS text messaging services to provide you with important information about our dealership services, including:

  • Transactional Messages: Appointment reminders, order confirmations, account notifications, service updates, and payment reminders
  • Marketing Messages: Special offers, promotions, new product announcements, exclusive dealership events, and educational content about our services
Message Frequency:

Message frequency varies depending on your interaction with our services. You may receive up to 10 messages per month for marketing communications and varying frequencies for transactional notifications based on your account activity.

2. Opt-Out Instructions

You can cancel the SMS service at any time. Simply text "STOP" to (845) 814-1203. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us.

5. Message and Data Rates

Standard message and data rates may apply for any messages sent to you from us and to us from you. The number of messages you receive will depend on your interaction with our services and the preferences you've selected.

Message frequency varies. For questions about your text plan or data plan, please contact your wireless service provider.

Supported Carriers: Our SMS service is available on all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and other participating carriers.

6. Carrier Liability Disclaimer

IMPORTANT: Carriers are not liable for delayed or undelivered messages. AutoTalk Solutions and participating carriers are not responsible for any delays or failures in message delivery that may occur due to network issues, technical problems, or other factors beyond our control.

7. Privacy and Data Protection

We take your privacy seriously. Your personal information, including your mobile phone number, will be used in accordance with our Privacy Policy.

8. Consent Requirements

By providing your mobile phone number and opting in to receive text messages, you expressly consent to receive:

Your consent is not a condition of purchase. You may still use our services without subscribing to SMS notifications.

10. Prohibited Content

In compliance with carrier regulations and to maintain the integrity of our messaging services, AutoTalk Solutions strictly prohibits the following types of content:

PROHIBITED MESSAGE CONTENT:
  • Phishing, Smishing, and Social Engineering: Any attempts to manipulate users into sharing private information
  • Illegal Content: Content that is illegal under federal law or the laws of any U.S. state
  • SHAFT Content: Messaging related to Sex, Hate, Alcohol, Firearms, and Tobacco (unless compliant with all federal and state age-gating requirements and regulations)
  • Fraudulent or Deceptive Content: Any misleading, fraudulent, or deceptive messaging

Violations of these content policies may result in immediate termination of SMS services and potential legal action.

11. Service Modifications and Termination

AutoTalk Solutions reserves the right to modify, suspend, or terminate the SMS messaging service at any time, with or without notice. We may also modify these Terms of Service periodically, and your continued use of our services constitutes acceptance of any changes.

12. Limitation of Liability

To the fullest extent permitted by law, AutoTalk Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the SMS messaging service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our SMS service
  • Any bugs, viruses, or other harmful code that may be transmitted through our service

13. User Responsibilities

By using our SMS service, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your contact information
  • Notify us immediately of any unauthorized use of your account
  • Comply with all applicable local, state, national, and international laws
  • Not use our service for any illegal or unauthorized purpose

14. Dispute Resolution

Any disputes arising out of or relating to these Terms of Service or our SMS messaging service shall be governed by the laws of the State of New York, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AutoTalk Solutions regarding the use of our SMS messaging service.
